MOTOR VEHICLE ACCIDENT WITH PERSONAL INJURY

The statute of limitation controls the time period in which you may file a civil action. If your time expires under the applicable statute of limitation you lose your right to file a civil action.

When you have a motor vehicle accident and a personal injury claim from same, the two year statute of limitation applies from the date of the accident.

KRS 304 extends the statute of limitation to two years from date of wreck or lost PIP payment (for treatment of injuries clearly sustained in the accident) for action arising from the ownership, maintenance, or use of a motor vehicle arising in Kentucky.

Our office is very conservative in filing motor vehicle/personal injury cases and files said actions within one year of the date of the accident/injury.
